Expertengruppen der EU-Kommission (engl. EU Expert Groups, European Commission’s advisory groups) sind vor der eigentlichen Gesetzgebung tätig.
sind von Unternehmensvertretern durchsetzt
Sie beraten und erarbeiten Grundlagen bei der Vorbereitung von Gesetzgebungsvorschlägen und politischen Initiativen der EU-Kommission.

Beiträge haben keine bindende Wirkung. Dennoch sind Sie im Gesetzgebungsprozess wichtig, da sie als erste Informationsquelle dienen. Die Arbeitsweise der Expertengruppen findet in der Form von Treffen bzw. Sitzungen statt. Hierbei werden Stellungnahmen, Empfehlungen und Berichte erstellt.

Beschreibung der Expertengruppen

Die EU-Kommission greift häufig auf externe ExpertInnen zurück. Expertengruppen beraten die EU-Kommission bei der Vorbereitung von Gesetzgebungsvorschlägen und politischen Initiativen.

Es gibt 2 Arten:

• formelle Expertengruppen – eingesetzt durch einen Beschluss der EU-Kommission
• informelle Expertengruppen – eingesetzt von einer einzelnen Kommissionsdienststelle

Diese werden noch unterschieden in Ständige und Nichtständige Expertengruppen.

Mitglieder von Expertengruppen:

• Einzelpersonen die als unabhängige ExpertInnen gelten
• Einzelpersonen, die Interessen einer Interessengruppe in einem bestimmten Politikbereich vertreten
• Organisationen im weiteren Sinne (also Unternehmen, Lobbyverbände, NGOs, Gewerkschaften, EU-Einrichtungen). Sie benennen Einzelpersonen als ihre ständigen Vertreter
• Regionale oder kommunale Behörden von Mitgliedstaaten. Sie ernennen ihre Vertreter in der Gruppe

Kritik des Europäischen Parlaments an den Expertengruppen

• Der Haushaltsausschuss des EU-Parlament hat sich dafür ausgesprochen, die Finanzierung der so genannten "Expertengruppen" teilweise einzufrieren.

die EU-Abgeordneten fordern einheitliche Auswahlkriterien, damit die Expertengruppen endlich ausgewogener besetzt werden. Außerdem muss erkennbar sein, wessen Interessen sie wirklich vertreten. • Bereits 2012 hatte das EU-Parlament die Mittel für die Expertengruppen eingefroren und erst nach der Zusage der EU-Kommission freigegeben, ernsthafte Reformen gegen die Dominanz von Wirtschaft und Finanzlobby einzuleiten.

• Im November 2011 fror das EU-Parlament das Budget der Expertengruppen ein.

The European Parliament demanded that its four conditions were formalised before the budget freeze was lifted: no corporate domination of Groups; no lobbyist sitting in Groups in a 'personal capacity' (i.e. pretending to be independent); public calls for application for all new Groups; and full transparency.
in March 2012, that the Commission undertook a full review of all its Expert Groups. The budget freeze was lifted September 2012 under the proviso that the conditions would be treated as de facto rules as the official review of the horizontal rules (those that apply to all Groups and all departments aka DGs) wasn't until 2015. An informal process between the Parliament and the Commission was launched to oversee the implementation, with the Parliament threatening to re-freeze the budget if progress wasn't made.

On 14 May 2014, European Ombudsman Emily O'Reilly announced that she would be launching her own investigation into Expert Groups to achieve “a more balanced composition (link is external).” The focus of the investigation looks at the how the four conditions have been applied since the budget freeze was lifted, and aims to bring stakeholders into the process as much as possible 22. Kritische Studien zu Expertengruppen

Die Kritik an den Expertengruppen erwächst dabei aus deren Besetzung, die in den meisten Fällen unausgewogen ausfällt. Gewerkschaften, Umweltverbände und Verbraucherschützer sind dabei genau so benachteiligt wie der Rest der Zivilgesellschaft. Häufig bilden die Anstöße der Expertengruppen das Fundament für die politischen Vorschläge der EU-Kommission und werden im Verlauf eines Prozesses, in dem oft nur wenige Änderungen eingefügt werden, schließlich als europäische Gesetzgebung verabschiedet. Von einer Pluralistischen Interessenartikulation sowie Partizipation kann daher nicht die Rede sein. Viele Gesetze werden dadurch bereits vor der Initiative der EU-Kommission von Lobbyisten aus der Wirtschaft beeinflusst.

Ergebnis: Studie hat gezeigt, dass viele der Expert Groups weiterhin dominiert sind von Interessen von Großkonzernen. Andere Org. sind unterrepräsentiert

Fazit: Lobbyisten – particularly representing corporate interests – are still being labelled as ‘independent’ in Expert Groups.

The Commission’s claim that the problem is purely administrative also downplays the highly political nature of the problem: that the Commission has been accepting supposedly-impartial advice from big business. How was this allowed to happen – where was the conflict of interest policy that ensured independent experts were actually independent?

• 2008 in einer Studie gezeigt wurde, werden die Expertengruppen mehrheitlich durch Industrieverbände und Unternehmenslobbyisten dominiert.

• Eine Studie im Auftrag von ÖGB und AK ergab aber im Frühjahr, dass sich nicht viel geändert hat. In 17 untersuchten Expertengruppen stammten nach wie vor etwa 70% der Mitglieder aus der Finanzindustrie. Gewerkschaften waren fast gar nicht vertreten.

Es gibt aktuell ca. 800 Expertengruppen die Ad-hoc zu sehr spezifischen Themen eingesetzt werden. Die Anzahl der Expertengruppen kann jedes Jahr variieren, da es zeitlich begrenzte (Nichtständige) und zeitlich unbegrenzte (Ständige) Expertengruppen existieren. Zudem werden jedes Jahr neue Expertengruppen initiiert. Eine vollständige und aktuelle Auflistung findet man in dem seit 2005 eingeführten Online-Register der Expertengruppen.

De Larosière Expert Group / High-Level Group on Financial Supervision in the EU

The European Commission’s response to the financial crisis was guided by the De Larosière Expert Group, named after its chair and senior banking industry figure, Jaques De Larosière Formally known as the High-Level Group on Financial Supervision in the EU, 4 der 8 members had close links with the same banks most implicated in the crisis (Goldman Sachs, Citigroup, Lehman Brothers, BNP Parisbas), while a 5. was a known advocate of deregulation and a 6. worked for the UK Financial Services Authority Es gab einen Ergebnisreport von dieser Gruppe

Nachdem im ersten Halbjahr 2013 viel über die Steuervermeidungsstrategien von multinationalen Unternehmen wie Apple oder Starbucks berichtet wurde, richtete Mitte 2013 die EU-Kommission diese Expertengruppe zum Thema ein.
Die Expertengruppe, Kurzform: "Plattform", besteht aus 28 VertreterInnen der EU-Mitgliedsländer sowie 15 VertreterInnen von Nichtregierungsorganisationen. 9 der 15 "NGOs" sind Unternehmerverbände, Handelskammern sowie Wirtschaftsprüfer- und Steuerberatervertretungen, zB. Businesseurope, International Chamber of Commerce (ICC, Internationale Handelskammer) Confédération Fiscale Européenne (C.F.E., europäischer Steuerberaterverband). Akteure also, die die effektive “Vermeidung” von Steuern bisher erfunden, gefördert oder zumindest schweigend geduldet haben. ,

Gängige Praxis ist, dass die Expertengruppen einen ersten Vorschlag für EU-Gesetze vorlegen. Als Mitglied einer solchen Expertengruppe erfährt dieser somit einen privilegierten Zugang zu den politischen Gestaltungsprozessen der EU.
